Chapter 13 bankruptcy is known as a reorganization of one’s debts.  It involves submitting one’s disposable monthly income to a Chapter 13 trustee who administers those funds for the benefit of creditors.
Disposable monthly income is determined by taking one’s monthly income from all sources and subtracting one’s necessary living expense.  Whatever amount remains must be committed to a Chapter 13 plan.  The plan typical runs from 36 to 60 months.  There is a hierarchy in terms of payments to creditors.  Typically, secured creditors are paid prior to other debts with unsecured debts being paid last.

A person received a discharge in Chapter 13 once the required payment plan is completed.  There are certain circumstances by which a person can repay all of his debt and yet still not receive a discharge.  Please consult with an experienced bankruptcy attorney to determine whether or not you may be eligible to receive a discharge under Chapter 13 of the bankruptcy code.
